Nos tempos modernos, a doutrina do direito natural tem sido negada por muitos autores. Não foi assim entre os medievais e entre os antigos. Tomás de Aquino, em diversas partes de sua obra, trata do tema e mostra como a própria racionalidade do homem o leva a descobrir algo que está insito no mais intimo de sua natureza.

O objetivo deste artigo é discutir a noção humiana de "crença", frequentemente vita como adendo "psicológico" à correta doutrina epistemológica do autor. Tenta-se sugerir que são partilha das obsessões da epistemologia contemporânea.

ResumoNo início do século xviii, Isaac Newton publicou seu principal trabalho sobre óptica, o Opticks. Impregnado por uma perspectiva indutiva, o livro logo se tornou a principal referência para os estudos sobre a luz e as cores, sendo amplamente popularizado pelos seguidores de Newton. Neste artigo, analisamos como dois importantes livros contribuíram para essa popularização e também qual era a imagem de ciência que tencionavam propagar, o Élements de la philosophie de Newton de Voltaire e o Newtonianismo per le dame (...) de Algarotti. Será possível perceber que ambos os autores distorceram o conteúdo do livro de Newton, no intuito de propagar uma imagem idealizada das ideias newtonianas e da própria filosofia natural.In the beginning of 18th century, Newton published his main work about light and colors, the Opticks. Impregnated by an inductive perspective, the book became the major reference for the studies about light and colors, being widely popularized by Newton's followers. In this article, we analyze how two important works contributed to this process of popularization and also what image of science they intended to propagate: Voltaire's Elements of Newton's philosophie and Algarotti's Sir Isaac Newton's philosophy explain'd for the use of the ladies. We will be notice that both authors distorted the content of the Opticks, in order to propagate an idealized image of Newtonian ideas and natural philosophy itself. (shrink)

Le présent article part d’une proposition de Giorgio Agamben issue du livre La communauté qui vient, consistant à penser une communauté non appropriable, c’est-à-dire, une communauté pour des individus ontologiquement indéterminés et qui ne pouvant pas être appropriés par les appareils du pouvoir. En ce sens, nous essayons de montrer comment la formation sociale conçue par Agamben peut dialoguer avec l’idée de multitude de Michael Hardt et Antonio Negri. À cette fin, sont exposées les similitudes entre la communauté « qui (...) vient » de Agamben et la multitude. En séquence, nous discutons le rôle individualisant de la loi et de la politique occidentale, comprises comme mécanismes hiérarchiques dont la fonction est précisément d’empêcher l’émergence de la multitude. p { margin-bottom: 0.21cm; } O objetivo do presente artigo é discutir a concepção de Direito, Justiça e Estado no pensamento estoico greco-romano, demonstrando a atualidade do tema e suas conexões com problemas contemporâneos tratados pela Filosofia do Direito, tais como os da legitimidade do poder e do universalismo da ordem jurídica. Em um primeiro momento são apresentados e problematizados elementos centrais da filosofia estoica, tais como as noções de lei natural, liberdade interior, igualdade formal e universalismo. Em seguida, mediante (...) uma análise histórica e filosófica de caráter crítico-comparativo são apresentados os três principais projetos de república pensados pelos estoicos: 1) a república radical e igualitarista de Zenão (ap. 334 a.C. – 262 a.C.), na qual se nega a juridicidade, eis que o direito é entendido como construção artificial que impede a fruição da liberdade; 2) a república legalista de Cícero (106 a.C. – 43 a.C.), quando o direito natural é positivado para servir enquanto instância racional de auto-reflexão e de auto-fundamentação das normas jurídico positivas e, finalmente, 3) a “república” de Sêneca (4 a.C. – 65 d.C.), na qual o direito inicialmente se deixa absorver pelo poder pessoal do Imperador Romano para, em um segundo momento, mostrar-se como elemento universal, preparando assim as bases para a futura concepção de direitos fundamentais própria da modernidade. A crítica de Leibniz à prova a priori da existência de Deus, retomada de Anselmo por Descartes, resume-se à observação de que, antes de admitir a existência de um ser perfeitíssimo, é preciso provar a possibilidade d noção de um tal ser; e, para isso, é preciso mostrar a compatibilidade entre as perfeições divinas. A prova é correta, mas incompleta. Leibniz jamais completou essa prova, com exceção de um texto escrito em 1676, porque, para isso, precisaria lançar mão de sua (...) Característica universal, cujos elementos seriam os pensamentos simples que exprimiriam as formas simples ou perfeições divinas. O projeto de criação de uma língua formal ou Característica universal, embora tenha permanecido inacabado, jamais foi abandonado por Leibniz. Todavia, ao delinear o projeto, Leibniz esclarece que a Característica explicaria com exatidão as verdades necessárias, mas não as verdades contingentes. Ora, se fosse possível provar a compatibilidade entre as perfeições divinas,seria também necessário explicar como a incompatiblidade entre os mundos possíveis se origina dessa compatibilidade primordial; seria preciso explicar como o contingente nasce do interior do necessário. La province jésuite du Brésil est parcourue au début du XVIIe siècle par une série de tensions qui relèvent autant de son rapport à la société coloniale contemporaine que de ses relations avec le centre romain. À travers l'étude d'un document programmatique exceptionnel et original, dont l'auteur et la date de rédaction demeurent inconnus, les Advertências para a provincia do Brasil, on analyse l'inscription de l'entreprise missionnaire dans sa double dimension économicopolitique, avec l'engagement dans la production sucrière, et spirituelle, assurer (...) le salut du missionnaire et la conversion des Indiens. Ce projet, qui fait de l'a ldeia la structure déterminante de la présence et de l'action jésuites en terre de Brésil, révèle une vision globale de la mission, à la fois géopolitique, économique et religieuse que l'historiographie traditionnelle a occultée au profit d'une approche exclusivement spirituelle. Recent years have been blessed with an abundance of logical systems, arising from a multitude of applications. A logic can be characterised in many different ways. Traditionally, a logic is presented via the following three components: 1. an intuitive non-formal motivation, perhaps tie it in to some application area 2. a semantical interpretation 3. a proof theoretical formulation. There are several types of proof theoretical methodologies, Hilbert style, Gentzen style, goal directed style, labelled deductive system style, and so on. The (...) tableau methodology, invented in the 1950s by Beth and Hintikka and later per fected by Smullyan and Fitting, is today one of the most popular, since it appears to bring together the proof-theoretical and the semantical approaches to the pre of a logical system and is also very intuitive. In many universities it is sentation the style first taught to students. Recently interest in tableaux has become more widespread and a community crystallised around the subject. An annual tableaux conference is being held and proceedings are published. The present volume is a Handbook a/Tableaux pre senting to the community a wide coverage of tableaux systems for a variety of logics. It is written by active members of the community and brings the reader up to frontline research. It will be of interest to any formal logician from any area. (shrink)

In this paper, we aim at highlighting the significance of the A- and B-properties introduced by Finch (Bull Aust Math Soc 2:57–62, 1970b). These conditions turn out to capture interesting structural features of lattices of closed subspaces of complete inner vector spaces. Moreover, we generalise them to the context of effect algebras, establishing a novel connection between quantum structures (orthomodular posets, orthoalgebras, effect algebras) arising from the logico-algebraic approach to quantum mechanics.

“Do Anthropocene narratives confuse an important distinction between the natural and the historical past?” asks Giuseppina D’Oro. D’Oro defends the view that the concept of the historical past is sui generis and distinct from that of the geological past against a new, Anthropocene-inspired challenge to the possibility of a humanistically oriented historiography. She argues that the historical past is not a short segment of geological time, the time of the human species on Earth, but the past investigated from the perspective (...) of a distinctive kind of interest, that of uncovering the norms which governed historical agents in different periods of time. The past for the Egyptologist, or for the Roman historian, is not the same past studied by the palaeontologist or the geologist, not because it is infinitesimal short in comparison to geological time, but because the questions asked by historians concerned with the Egyptian or Roman civilization are not the same kind of questions asked by empirically minded scientists. She argues that the accusation that the distinction between the historical and the natural/geological past, rests on unacceptable form of human exceptionalism is based on the conflation of the concept of the historical past with that of the human past and that keeping alive the nature/culture distinction has important implications for praxis. If the distinction between nature and culture is collapsed, and the corollary that historical agents are not distinct in kind from natural agents (such as yeast and microbes) is accepted, then “the anticipation of the future would become a mere spectator’s sport analogous to the activity of predicting the weather”: collapsing the nature culture distinction, D’Oro argues, undermines the possibility of political action against the very threat (climate change) that motivates Anthropocene narratives in the first instance. Because rate of force development is an emerging outcome measure for the assessment of neuromuscular function in unfatigued conditions, and it represents a valid alternative/complement to the classical evaluation of pure maximal strength, this scoping review aimed to map the available evidence regarding RFD as an indicator of neuromuscular fatigue. Thus, following a general overview of the main studies published on this topic, we arbitrarily compared the amount of neuromuscular fatigue between the “gold standard” measure and peak, early and late (...) RFD. Seventy full-text articles were included in the review. The most-common fatiguing exercises were resistance exercises, endurance exercises/locomotor activities, isokinetic contractions, and simulated/real sport situations. The most widely tested tasks were knee extension and plantar flexion. The reason for evaluating RFD was lacking in 36% of the studies. On average, the amount of fatigue for MVF was comparable to late RFD but lower compared to both peak RFD and early RFD. Even if the rationale for evaluating RFD in the fatigued state was often lacking and the specificity between test task and fatiguing exercise characteristics was not always respected in the included studies, RFD seems to be a valid indicator of neuromuscular fatigue. Based on our arbitrary analyses, peak RFD and early phase RFD appear even to be more sensitive to quantify neuromuscular fatigue than MVF and late phase RFD. (shrink)

How does the study of society relate to the study of the people it comprises? This longstanding question is partly one of method, but mainly one of fact, of how independent the objects of these two studies, societies and people, are. It is commonly put as a question of reduction, and I shall tackle it in that form: does sociology reduce in principle to individual psychology? I follow custom in calling the claim that it does ‘individualism’ and its denial ‘holism’.

This is Part 1 of a paper on fibred semantics and combination of logics. It aims to present a methodology for combining arbitrary logical systems L i , i ∈ I, to form a new system L I . The methodology `fibres' the semantics K i of L i into a semantics for L I , and `weaves' the proof theory (axiomatics) of L i into a proof system of L I . There are various ways of doing this, we (...) distinguish by different names such as `fibring', `dovetailing' etc, yielding different systems, denoted by L F I , L D I etc. Once the logics are `weaved', further `interaction' axioms can be geometrically motivated and added, and then systematically studied. The methodology is general and is applied to modal and intuitionistic logics as well as to general algebraic logics. We obtain general results on bulk, in the sense that we develop standard combining techniques and refinements which can be applied to any family of initial logics to obtain further combined logics. The main results of this paper is a construction for combining arbitrary, (possibly not normal) modal or intermediate logics, each complete for a class of (not necessarily frame) Kripke models. We show transfer of recursive axiomatisability, decidability and finite model property. Some results on combining logics (normal modal extensions of K) have recently been introduced by Kracht and Wolter, Goranko and Passy and by Fine and Schurz as well as a multitude of special combined systems existing in the literature of the past 20-30 years. The renewed engagement with Aristotle’s concept of practical wisdom in management and organization studies is reflective of the wider turn towards practice sweeping across many disciplines. In this sense, it constitutes a welcome move away from the traditional rationalist, abstract, and mechanistic modes of approaching ethical decision-making. Within the current engagement, practical wisdom is generally conceptualized, interpreted or read as a form of deliberation or deliberative judgement that is also cognizant of context, situatedness, particularity, lived experience, and so on. We (...) argue that while this way of conceptualizing practical wisdom moves closer to practice in accounting for the concrete and particular reality within which individuals enact ethics, it does not adequately account for practice in the ontological and relational sense posited in practice theories. Practical wisdom conceptualized on the _deliberative_ dimension still retains a higher emphasis on distinct entities (individuals/institutions), reflexive agency, conscious mental states, goal-directed action, and intentionality. In other words, it puts a higher stress on individual _wisdom_, as opposed to _practice_ or the relational interaction of the individual and social inhering in practice. We offer an alternative conceptualization of practical wisdom based on the _dispositional_ mode of being in the world which is rarely deliberate, intentional, or reflective. Our conceptualization integrates Aristotle’s original ethical framework, which is already embedded in a practice-based ontology, with insights from practice theories to show how practical wisdom is intuitively channelled in the _dispositional_ mode in a given social configuration of virtues/ends. Instead of solely being considered in economic terms, or in terms of accuracy and desirability, ethical questions should also be asked such as ‘is this a good thing to do?’. This article considers whether moral people would ‘design’ and genetically engineer their babies and applies the moral theories of virtue ethics, deontology and utilitarianism to help guide our ethical decision-making in relation to this complex issue. The Lunyu 論語 (Analects of Confucius), Daodejing 道德經 (Classic of the Way and Virtuosity) or Laozi 老子 (Book of Master Lao), and the Zhuangzi 莊子 (Book of Master Zhuang) have been broadly classified as representative of Confucianism (Lunyu) and Daoism (Laozi and Zhuangzi). This loose grouping, and the similarities and differences associated with these “schools” include some of the most telling and simultaneously misleading generalizations about Chinese philosophy or thought in general. These articles seek to provide an overview of the (...) relationship between Confucianism and Daoism. The first article begins before with a generalized topics based comparison of the Lunyu, Laozi and Zhuangzi. The latter two texts include their own significant differences, but I will, wherever possible, look for generalities that fit both. The major themes considered in this first part are (1) the perspectives on names (ming 名) and actualities (shi 實), (2) cultivation, learning, and what is considered natural (ziran 自然), and finally (3) conceptions of the person. Thomas de Vio Cajetan produced a highly influential Thomistic treatise on analogy entitled De nominum analogia. The merits of this work have been contested since the sixteenth century. Notable twentieth-century Thomists who adopted many of the teachings of De nominum analogia include Jacques Maritain and Yves Simon. Joshua Hochschild’s The Semantics of Analogy highlighted the significance of chapter ten, where Cajetan applies his theory to resolve the problem of demonstrations that use analogous terms, with the explicit purpose of addressing a (...) serious challenge from Scotists regarding the use of analogy in metaphysics. This paper examines the criticism of Cajetan’s way of using analogous terms in demonstrations by the seventeenth-century Franciscan Scotist Bartolomeo Mastri. It shows how the Thomist differs from the Scotist and analyzes these rival positions. (shrink)

En este artículo se quiere trazar una teoría política de la insurrección en el pensamiento de Max Stirner, en tanto alternativa ética y política a la revolución. Se mostrará cómo, según el pensador alemán, la revolución es en última instancia una estrategia fallida de emancipación en tanto en cuanto no libera al individuo de las formas de subjetividad que lo mantienen dependiente del poder. Más en general, se enseñará como el orden liberal post-revolucionario, detrás del lenguaje secular de los derechos, (...) las libertades y la igualdad, engendra técnicas más sutiles de gobernabilidad del individuo. La insurrección, en cambio, puede ser vista como un rechazo de las identidades y de los roles que disciplinan al individuo. Al respecto, se prestará una atención especial al concepto stirneriano de Eigenheit, como estrategia ética de auto-determinación y liberación de las formas rígidas de la subjetividad. En última instancia, se querrá mostrar cómo todo el proyecto político de la insurrección stirneriana se basa en un anarquismo ontológico que rechaza la lógica teleocrática del racionalismo moderno y pone en entredicho la misma noción de realización. The aim of this article to outline a political theory of insurrection in Max Stirner’s thought as an ethical and political alternative to revolution. I will show that revolution is ultimately a failed strategy of emancipation as it does not free the individual from the forms of subjectivity that keep her dependent on power. Insurrection, on the other hand, can be seen as a rejection of the identities and roles that discipline the individual. In this regard, special attention will be paid to the Stirnerian concept of Eigenheit as an ethical strategy of self-determination and liberation from rigid forms of subjectivity. Ultimately, I will show how the whole political project of the Stirnerian insurrection is based on an ontological anarchism that rejects the teleocratic logic of modern rationalism and calls into question the very notion of realization.
